Medi Venture Care Terms and Conditions

It is compulsory to read and state that you have read and agreed to the Medi Venture Care Terms and Conditions below:

Medi Venture Care’s Terms and Conditions set out the contractual terms and conditions in relation to the services provided to you by Medi Venture Care.

By making any inquiry or booking with Medi Venture Care, you agree to be bound by these Terms and Conditions.

If any information provided by or on behalf of Medi Venture Care is inconsistent with these Terms and Conditions, then you agree that these Terms and Conditions prevail to the extent of any inconsistency.

“You” in the terms listed below refers to the patient directly or his or her relative/friend or anyone making the booking or payment on his/her behalf or accompanying the patient during his/her medical treatment in India.

Medi Venture Care is registered in India and:

• Provides preliminary consultation or medical opinion of doctors/surgeons for your medical condition.
• Plans your medical, travel, and accommodation itinerary and assists you in the execution of the same (herein referred to as Treatment Consultation, Planning & Facilitation Services).
• Books plastic/cosmetic surgery, dentistry, cardiac, neurological/neurosurgical, spinal, orthopedic, joint replacement, and other procedures/surgery (herein referred to as the Surgery Booking Services).
• Books hotels, serviced apartments, or other accommodations for you (herein referred to as the Accommodation Booking Services).

Important Term: Other than making information and expert opinion from third parties available to you, introducing you to third-party providers of goods and services, and booking services, Medi Venture Care is not itself providing you with any goods or services in the capacity of a principal-agent or sub-contractor.

Important Term: Third-party principals (who are not agents of or sub-contractors to Medi Venture Care) provide all goods and services to you (including consultations, opinions, procedures, operations, surgery, travel, activities, and meals) that may have been booked by Medi Venture Care on your behalf.

Whilst Medi Venture Care will use its best endeavors to exercise every reasonable care in the selection of the third parties to whom you are introduced and who may provide goods and services to you, Medi Venture Care shall not be liable to you in any way whatsoever for any damage, loss, or injuries which you may suffer arising from or in relation to goods, services, or consultations provided by these third parties.

It is important to note, therefore that:

(a) Medi Venture Care’s role is merely to introduce suppliers of those goods and services to you and pass on their opinion to you “as is”. Medi Venture Care does not make any express or implied representation or warranty that any services or goods supplied by third parties to you will be fit for your required purpose or supplied with reasonable care and skill.

(b) The services and goods to be provided by third parties are subject to the terms and conditions and limitations of liability separately imposed by hospitals, clinics, hotels, airlines, and other providers of goods and services to you, some of which limit or exclude liability in respect of death, personal injury, delay, and loss or damage to baggage.

Warranties

Information accessed through Medi Venture Care’s website and other touch points is presented in summary form and is not exhaustive. Medi Venture Care makes no warranties or representations as to its accuracy or completeness. This information is provided “as is” without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

The information accessible from the Medi Venture Care website and other communication channels contains forward-looking statements that involve risks and uncertainties, including statements regarding the potential benefits of healthcare plans or medical procedures and successful treatment outcomes. Actual results may differ materially from those indicated by such statements.

Application for Treatment or Procedures

Patient applications submitted through our website or by phone call are received by advisors trained to answer general questions about procedures and service terms. Questions related to medical issues are referred to medical professionals for expert opinion.

We always encourage you to ask as many questions as possible to clear your doubts. No question is too small. You may request your case manager to provide the direct contact number of the treating doctor to help make informed decisions.

Important Term: Medi Venture Care’s case managers take all precautions to pass on information and opinions from surgeons “as is”. Medi Venture Care does not guarantee that consultations passed on to you will suit your requirements and cannot be held responsible if the surgeon’s opinion changes following face-to-face consultation.

Quotations

The amount fixed by Medi Venture Care during the initial stage is an estimate. The final amount will be confirmed after face-to-face consultation. The original estimate may be modified after the patient’s personal evaluation upon arrival in India.

Items Included in the Quotation

The quotation for a standard medical trip includes:

• One surgeon consultation
• Services of the surgeon for the selected procedure(s)
• Services of an anesthesiologist (if required)
• Post-operative accommodation at the clinic or hospital
• Operation theatre charges
• General medication immediately following surgery
• Post-operative consultation prior to departure
• Airport transfers
• One follow-up transfer after discharge

The Quotation Does Not Include

• Additional medical expenses due to unforeseen complications
• Travel insurance or medical insurance
• Transfers for dental procedures
• Procedures not included in the estimate
• Tours or outings
• Additional expenses not specified in the estimate
• Meals unless specifically included
• Air tickets or transport
• Airport taxes, road tolls, laundry, beverages, gratuities, or tips
• Additional costs caused by weather or transport failures
• Taxes levied by the Government of India

Pre-Existing Diseases

Known Pre-Existing Diseases

Patients with known pre-existing diseases may be required to pay an additional deposit if the treating doctor considers it necessary for additional investigations or specialist medical support.

Unused deposits related to pre-existing diseases will be refunded if not required.

We strongly advise patients to disclose all medical conditions, medications, and previous procedures.

Unknown Pre-Existing Diseases

If compulsory medical studies reveal previously unknown medical conditions:

• The patient will be informed.
• Additional deposits may be requested for investigations or specialist care.
• Unused deposits will be refunded.
• Surgeons will not perform procedures that may negatively affect patient safety.

Important Term: Any unforeseen complications arising from pre-existing conditions including diabetes, hypertension, and similar conditions remain the patient’s responsibility. Medi Venture Care shall not be held responsible for such complications.

Important Term: The surgeon and Medi Venture Care are under no obligation to proceed with treatment if a pre-existing condition makes the patient ineligible for the procedure. Deposits paid in such circumstances are non-refundable.

Unforeseen Complications

If complications arise requiring additional interventions or extended hospitalization, the cost shall be determined by the treating surgeon or hospital and paid by the patient.

Important Term: All medical procedures carry risks and limitations, including the possibility of dissatisfaction with results.

Reservations and Payments

Once travel dates and treatment plans have been agreed upon, you will make full payment towards accommodation, flights, tours, and non-refundable administration fees to secure bookings.

Deposits payable to Medi Venture Care can be paid via bank transfer as specified in the invoice and deducted from the agreed estimate.

The balance shall be paid directly to the surgeon or hospital before the procedure.

Important Term: Accommodation, flight, and tour bookings that are cancelled will be subject to third-party cancellation fees.

Advance fees paid towards surgical bookings are non-refundable.

Credit card payments are subject to exchange rate fluctuations determined by the issuing bank.

Arrival in India

Following arrival in India, patients will attend an appointment with the nominated surgeon according to their itinerary.

Consultation with the Surgeon

The consultation serves several purposes:

• Explanation of the procedure and surgery.
• Completion of required consent forms.
• Opportunity for the patient to ask questions.
• Determination of any additional procedures that may affect costs.

We encourage patients to:

• Ask questions.
• Understand expected outcomes.
• Discuss alternatives and risks.

Important Term: You agree to the procedure, outcomes, and risks after face-to-face consultation with your surgeon and acknowledge that you understand all possible complications.

Booking of Tours and Return Travel

Recovery periods vary by patient. Timelines provided are estimates only and return travel dates may need adjustment.

Important Term: Medi Venture Care cannot be held responsible for changes to travel plans due to recovery variations.

Variation in Booking

Travel dates may be amended subject to third-party fees and surcharges.

Deposits for surgical procedures may be retained as credit for six months and new estimates may apply at the time of treatment.

Passport and Visa

You require a valid passport and appropriate visa to enter India.

Important Term: Medi Venture Care may assist in obtaining supporting documentation for medical visas but is not a travel agent and does not provide immigration advice.

Insurance

Medi Venture Care does not include insurance in treatment costs.

Patients are strongly advised to obtain travel insurance covering cancellation, medical expenses, baggage loss, travel delays, personal liability, and related risks.

Some policies may not cover elective surgery or malpractice claims and specialist insurance should be considered.

Important Term: Medi Venture Care does not provide insurance advice or recommend specific insurance products.

Limitation of Responsibility and Liability

Medi Venture Care provides Accommodation Booking Services and Surgery Booking Services only.

Other than introducing third-party service providers and facilitating bookings and payments, Medi Venture Care is not itself providing medical treatment or healthcare services.

Medi Venture Care does not make any warranties regarding services provided by hospitals, doctors, airlines, hotels, or other third parties.

Neither Medi Venture Care nor its officers, employees, or directors are doctors or healthcare professionals qualified to provide medical advice.

Medi Venture Care accepts no liability for acts, omissions, negligence, delays, or defaults of hospitals, airlines, doctors, hotels, clinics, or other third-party providers.

Patients agree to be bound by all contracts entered into with third-party service providers.

Medi Venture Care shall not be liable for losses, damages, delays, expenses, or inconvenience caused by force majeure events or circumstances beyond its control.

The services provided by Medi Venture Care shall be deemed to be made in UPDATE THIS, and disputes shall be governed by the laws of India and subject to the jurisdiction of UPDATE THIS.

Any provision of these Terms and Conditions that is void, illegal, or unenforceable shall not affect the validity or enforceability of the remaining provisions.

Organization-Specific Details Requiring Update

• UPDATE THIS → Registered office details if you intend to include them elsewhere in the agreement.
